1. About these terms

Your use of bodypharm.es ("the website"), and every purchase you make from us, is subject to these general terms and conditions of sale ("the terms"). Body Pharm ("we", "us", "our") runs the website; our company registration details can be obtained on request through our contact page. Using the website, opening an account or placing an order means you accept the terms. Should you not accept them, we ask that you refrain from using the website.

2. Definitions

  • "Products": the peptides, research chemicals and associated items in our range, each of which is supplied for research use alone.
  • "Research use only" / "RUO": exclusively for research and analytical purposes; not for consumption, ingestion, injection, application or any other in vivo use, whether in humans or in animals.
  • "Eligibility check": the step completed before purchase in which you confirm that you are 18 or older and accept that the products are RUO in nature.
  • "Order": a request from you to buy products.

3. Eligibility

Using the website and buying products requires that you are 18 or older; that you go through the eligibility check and supply accurate details, a valid date of birth among them; that you acknowledge every product is for research use only and not meant to be consumed by humans or animals; and that you are buying as a personal or professional researcher rather than on a minor's behalf. Where we have reasonable grounds to think these requirements are unmet, we may decline or cancel an order and suspend or close an account.

4. Research use only: nature of the products and your responsibility

At the heart of the sale lies this condition. You acknowledge and accept the following:

  • every product is sold for research and analytical purposes exclusively, and none is a medicine, medical device, food supplement, cosmetic or food;
  • the products are neither intended, authorised nor approved for consumption by humans or animals or for any in vivo use, and may not be put to any such use;
  • nothing stated on the website, product descriptions, articles, dosing content, comparisons and reviews included, amounts to medical, veterinary or professional advice, nor to an instruction to consume any product;
  • responsibility rests with you alone for the products being handled, stored, used and disposed of safely and lawfully, in line with all applicable law and good laboratory practice, and for making sure that anyone who handles them has the competence to do so;
  • no product will be resold, supplied or presented by you as being suitable for use in humans or animals.

5. Product information, prices and availability

Although we make every effort to describe products accurately, images and descriptions serve as general information and errors are possible. All prices appear in euros (EUR), include applicable taxes unless stated otherwise, and are subject to change without notice. Where a genuine and obvious error in a price or description affects your order, we may cancel the order (even once accepted) and refund whatever you have paid. A product may be temporarily out of stock; if a waitlist is available, joining it lets us tell you when the product is back. Being on the waitlist is not an order: it reserves no stock and is no guarantee of availability or of price.

6. Reviews and authenticity

Wherever reviews are shown on the website, our aim is to publish genuine opinions from real customers and to respect the applicable consumer protection law, including the ban on fake and misleading reviews. Because the products are research-use-only, we do not publish reviews that make medical or efficacy claims about them.

7. Orders and acceptance

By placing an order you make us an offer to buy products on these terms. The automatic acknowledgement you receive does not amount to acceptance. No contract exists until we accept the order, and acceptance takes place through the shipping confirmation (or another express confirmation of acceptance). An order may be declined or cancelled because, for example, a product is unavailable, we suspect fraud or misuse, the eligibility requirements are unmet, or a price or description was wrong. Where you have already paid for an order that we do not accept, the full amount is refunded.

8. Payment

Card payments go through PayTree, our external payment service provider, and by paying you accept PayTree's terms as well. You confirm that you are entitled to use the payment method you provide. Full card details are not stored by us. The availability and conduct of the payment service provider are outside our responsibility, although we will help where we reasonably can to resolve any payment problem connected with your order.

9. Shipping and returns

Our shipping offer is insured standard delivery to Spain at a flat rate; details are on our shipping page. Our returns offer is 14 days for unused, unopened products; once a product has been used or opened it cannot be returned unless it is faulty; details are on our returns page. None of these terms takes away the statutory rights you have under applicable consumer law. The shipping and returns pages are incorporated into these terms.

10. Your account and your obligations

Give accurate details on registration and keep them current; verify your email address when prompted; and keep your login credentials to yourself. Everything done through your account is your responsibility. If you suspect your account is being used without authorisation, tell us straight away via our contact page. Accounts that breach these terms, are used for unlawful ends or are used to misrepresent the products may be suspended or closed.

11. Acceptable use

You undertake not to: use the website or the products unlawfully or contrary to the RUO terms; present, resell or supply any product as suitable for use in humans or animals; give false eligibility or age details; try to gain unauthorised access to the website or interfere with it; or copy, scrape or misuse the content of the website, save where expressly authorised.

12. Intellectual property

Everything on the website, text, brand identity, the "Body Pharm" name and logo, images, articles and product descriptions included, is the property of us or our licensors and is protected by intellectual property law; reproducing or exploiting it requires our permission first. "Body Pharm" is our brand. Resellers, third parties and online marketplace sellers that we have not authorised are not "official Body Pharm" suppliers and do not have our endorsement; for the products, statements or conduct of unaffiliated resellers who claim to sell "Body Pharm" products we accept no responsibility. Authentic Body Pharm products are available only through bodypharm.es (or through channels we have expressly confirmed in writing).

13. Warranty disclaimers

The products come "as is" and for research use only. So far as the law allows, no warranty is given by us that a product is fit for purposes beyond the specification we publish, and we make no claim that a product is safe or fit for use in humans or animals; such use is prohibited. Website content (articles and comparisons included) is general information about research topics and not advice of any kind. We give no guarantee that the website will run without interruption or error.

14. Limitation of liability

Our liability is neither limited nor excluded by these terms where the law forbids that; this covers liability for death or for personal injury resulting from our negligence, liability for fraud, and any other liability that applicable law does not allow to be excluded (certain consumer rights among them). With that proviso, and bearing in mind that the products are research-use-only, we accept no liability for loss, injury, damage or liability arising from use of any product that contravenes these terms, which includes consumption by humans or animals and any in vivo use, or from handling, storage or disposal that fails to comply with applicable law and good laboratory practice; the whole risk of such prohibited use lies with you. The first sentence again prevails; beyond it, we accept no liability for indirect, special or consequential loss, nor for lost profit, lost business or lost data, and our aggregate liability in connection with any order is capped at the price you paid us for that order's products.

15. Indemnity

You undertake to hold us harmless from any claim, loss, liability, cost or expense (reasonable legal costs included) that results from your breach of these terms, from your misuse of the products (use in humans or animals included) or from your breach of applicable law in relation to the products.

16. Events beyond our control

Failures or delays caused by events outside our reasonable control (difficulties at the shipping provider, supply-chain breakdowns or action taken by the authorities, for example) are not our liability.

17. Governing law and jurisdiction

The applicable law governs these terms and any dispute that arises out of or relates to them. For consumers, the mandatory consumer protection provisions of the country of habitual residence remain unaffected.

18. Changes to these terms

These terms may be revised from time to time. Each order is governed by the version in force when it is placed. Whenever we make a change, the "last updated" date at the top is revised.
